US Panel in Talks of Granting Work Permits to Those Awaiting Green Cards

Among the major immigration discussions currently taking place in the USA, talks about extending EADs to EB-1,2 and 3 visa holders while their green card visas are being processed may help improve their quality of life.

Previously discussing extending the grace period of H-1B visa holders after their termination from their jobs, the presidential advisory commission has now opened a discussion over the possibility of issuing employment authorisation cards during the process for green card applications.

In this case, the proposal requests the DHS-USCIS to grant employment authorisations documents (EADs) and other travel documents to those with approved I-140 employment-based visa petitions under the EB-1, EB-2 and EB-3 categories. This request will on see those under the above-mentioned categories who have been waiting for 5 years and above, regardless of if they had applied for the adjustment of status.

Ajay Jain Bhutoria, a member of the President’s Advisory Commission for Asian American Native Hawaiian and Pacific Islander commission, raised the issues faced by H-1B visa holders in the US.

Asserting the benefits of improving the lives of foreign national scientists, physicians and engineers, Ajay Bhutoria stated that the move will help the US not only retain global talent in the field of STEM but also attract more.

Immigrants in the US are currently facing challenges regarding their future in the country as they are forced to either lose out on job opportunities or leave the country on account of their non-immigrant visas expiring before the immigrant visas can be processed. With the help of granting EADs during these approval periods, the US may continue to reap the benefits of foreign talent while the foreign nationals wait for their visas to be finalised, Bhutoria commented.

Additionally, such a move will greatly benefit foreign-born scientists, physicians and engineers, who would be able to provide for their families and have better stability and security during such uncertain times. In short, the policy would benefit both the US and foreign STEM professionals.

Bhutoria also spoke about the challenges faced by H-1B visa holders, adding that restricted career growth opportunities, visa limitations, lengthy processing times and much more have affected thousands of foreign nationals.

Granting these H-1B visa holders EADs will offer them improved career opportunities, security and even the ability to set up their businesses. Furthermore, such a grant will also allow foreign nationals to invest and build a life in the country and overall, live a better stress-free life.
