USCIS, on August 23, 2022, released a statement of having received enough H1-B visa applications to achieve the mandated target of 65,000 for 2023.

US Citizenship and Immigration Services (USCIS), on August 23, 2022, revealed in a statement that it has received enough applications to hit the mandated H1-B visa cap for 2023. The number of applications is enough to satisfy the advanced degree exemption cap of 2023 as well.

The target of 65,000 H1B regular visa caps and 20,000 H1B visa advanced degree exemptions were mandated for the fiscal year 2023.

H1B visa is a non-immigrant work permit that allows foreign internationals to get employed in the US for speciality occupations requiring theoretical and technical expertise. While the advanced degree exemption relates to the master’s cap, it is applicable to foreign professionals who have completed their master's courses in the US.

Every year, various US companies, especially Tech, employ a workforce of thousands from developing countries like India and China while relying on H1-B visas. Among foreign professionals, such as Indians, as well, the programme is highly sought after.

As the cap is expected to be easily achieved, USCIS is now replying with non-selection notifications to the registered applicants. The notification quotes, “Not Selected: Not Selected - not eligible to file an H1-B cap petition based on this registration.”

Meanwhile, the agency continues to accept applications from exempted petitioners.

The 2023 H1-B cap exempts petitioners who have been counted against the cap previously and retain their cap number.

The applications from current H1-B visa holders are also being accepted still. These include applications for visa extension, changes in employment terms, changes in employers, and concurrent work in additional H1-B positions.
